****पालघर जिल्ह्याच्या न्यायालयीन इतिहासातील पहिली फाशीची शिक्षा; ८ वर्षीय चिमुरडीवरील बलात्कार व हत्येप्रकरणी आरोपीला ‘मरेपर्यंत फाशी’****

पालघर जिल्ह्याच्या न्यायालयीन इतिहासात प्रथमच अल्पवयीन मुलीवरील लैंगिक अत्याचार आणि तिच्या निर्घृण हत्येच्या प्रकरणात आरोपीला **‘मरेपर्यंत फाशी’**ची शिक्षा सुनावण्यात आली आहे. डहाणू तालुक्यातील २०२१ मधील गाजलेल्या प्रकरणात अपर जिल्हा व सत्र न्यायालय, पालघर-१च्या न्यायाधीश श्रीमती ए. आर. रहाणे यांनी आरोपी प्रफुल्ल उर्फ प्रफुल्ल रत्ना घोषे (वय ५०, रा. वांगणपाडा, रानशेत, ता. डहाणू) याला दोषी ठरवत मृत्युदंडाची शिक्षा सुनावली.
न्यायालयाने आरोपीला ₹७५ हजारांचा दंडही ठोठावला असून, दंड न भरल्यास १ वर्ष ६ महिन्यांचा साधा कारावास भोगावा लागणार आहे.
या प्रकरणाला आणखी गंभीर स्वरूप यासाठी प्राप्त झाले की, अत्याचारानंतर आरोपीने चिमुरडीची हत्या केलीच, शिवाय घटनास्थळी आलेल्या व्यक्तीवरही कोयत्याने जीवघेणा हल्ला केला होता. उपलब्ध पुरावे, साक्षी आणि आरोपीचे कृत्य यांचा विचार करून न्यायालयाने हा कठोर निर्णय दिला.
*काय घडले होते त्या दिवशी?*
ही घटना २७ सप्टेंबर २०२१ रोजी डहाणू तालुक्यातील रानशेत येथील वांगणपाडा परिसरात घडली होती.
अवघ्या आठ वर्षे आठ महिने वयाची चिमुरडी आईने घराजवळील दुकानातून सामान आणण्यासाठी पाठवली होती. याच वेळी तिच्यावर पाळत ठेवून असलेल्या आरोपीने तिला फूस लावून आपल्या घरी नेले. त्याने मोबाईलवर अश्लील फोटो दाखवत तिच्यावर लैंगिक अत्याचार केला. त्यानंतर तिला खाऊसाठी १० रुपये दिले, अशी तपासातील माहिती समोर आली.
अत्याचारानंतर चिमुरडीने आरोपीला विरोध केला. तिने आपल्यासोबत घडलेली घटना आई-वडिलांना सांगणार असल्याचे सांगितले. त्यामुळे आरोपी घाबरला. आपला गुन्हा उघडकीस येईल या भीतीने त्याने घरातील कोयता हातात घेतला आणि चिमुरडीचा पाठलाग केला.
रस्त्यावर पळत असताना चिमुरडी पडली. त्यावेळी आरोपीने तिच्या डोक्यावर, मानेवर आणि चेहऱ्यावर १५ हून अधिक वेळा कोयत्याने वार केले. या हल्ल्यात चिमुरडीचा जागीच मृत्यू झाला.
अत्याचाराचा प्रत्यक्षदर्शी साक्षीदारही हल्ल्याचा बळी
चिमुरडीवर हल्ला होत असताना रस्त्यावरून जाणाऱ्या ४० वर्षीय व्यक्तीने आरोपीला अडवण्याचा प्रयत्न केला. मात्र आरोपीने त्याच्यावरही हल्ला केला. कोयत्याने त्याच्या मानेवर दोन वार करण्यात आले. या हल्ल्यात तो गंभीर जखमी झाला. त्यामुळे या प्रकरणात खुनासोबतच खुनाचा प्रयत्न आणि लैंगिक अत्याचाराचे गंभीर आरोप ठेवण्यात आले.
*पोलिसांनी तातडीने आरोपीला केली अटक*
घटनेनंतर तत्कालीन उपविभागीय पोलीस अधिकारी (SDPO), बोईसर विभाग, नित्यानंद झा (IPS) यांनी तपासाची सूत्रे हाती घेतली. तपासादरम्यान तांत्रिक, वैज्ञानिक, वैद्यकीय आणि परिस्थितीजन्य पुरावे संकलित करण्यात आले.
पोलिसांनी आरोपीला तातडीने अटक केली. या प्रकरणात भारतीय दंड संहितेच्या कलम ३७६, ३७७, ३०२ आणि ३०७, तसेच POCSO कायदा २०१२ मधील कलम ४, ६ आणि १२ अंतर्गत गुन्हा दाखल करण्यात आला.
२४ साक्षीदारांच्या साक्षीने खटल्याला बळ
न्यायालयीन सुनावणीदरम्यान सरकारी पक्षाने एकूण २४ साक्षीदार तपासले. प्रत्यक्षदर्शी साक्ष, वैद्यकीय व वैज्ञानिक पुरावे, तांत्रिक पुरावे आणि परिस्थितीजन्य पुरावे न्यायालयासमोर मांडण्यात आले.
सरकारी पक्षाच्या वतीने विशेष सरकारी अभियोक्ता अॅड. रेखा हिवराळे यांनी प्रभावी युक्तिवाद केला. तपास अधिकारी नित्यानंद झा (IPS) यांच्यासह महिला पोलीस उपनिरीक्षक विद्या नरेश बोरे आणि पोलीस उपनिरीक्षक संजय गावड यांनी न्यायालयीन प्रक्रियेत महत्त्वाची भूमिका बजावली.
या सर्व पुराव्यांचा सखोल विचार केल्यानंतर अपर जिल्हा व सत्र न्यायाधीश श्रीमती ए. आर. रहाणे यांनी आरोपीला दोषी ठरवले आणि **‘मरेपर्यंत फाशी’**ची शिक्षा सुनावली.
पॉक्सो ( POCSO )व निर्घृण हत्या प्रकरणात जिल्ह्यातील पहिलीच फाशी

अंतर्गत प्रकरण आणि अल्पवयीन मुलीच्या निर्घृण हत्येसाठी मरेपर्यंत फाशीची शिक्षा सुनावली जाण्याची ही पहिली घटना ठरली आहे. त्यामुळे २०२१ मध्ये घडलेल्या या प्रकरणाचा निकाल जिल्ह्याच्या न्यायालयीन इतिहासात महत्त्वाचा ठरला आहे.
****Palghar Court Awards First-Ever Death Sentence in District History****
**Accused Sentenced to ‘Hanging Till Death’ in Rape and Murder of 8-Year-Old Girl**
In a landmark judgment in the judicial history of Palghar district, the Additional District and Sessions Court, Palghar-1, has awarded the death penalty by ‘hanging till death’ to an accused convicted of sexually assaulting and brutally murdering an eight-year-old girl in Dahanu taluka in 2021.
Additional District and Sessions Judge Mrs. A. R. Rahane convicted Prafulla alias Prafulla Ratna Ghoshe, 50, resident of Vangandpada, Ranshet, Dahanu, and sentenced him to death.
The court has also imposed a fine of ₹75,000. In case of non-payment, the accused will have to undergo one year and six months of simple imprisonment.
The case assumes particular significance because the accused not only killed the child after the sexual assault but also attacked another person who attempted to intervene.
*The 2021 Incident*
The incident took place on September 27, 2021, at Vangandpada in Ranshet, Dahanu taluka.
The eight-year-old girl, aged about eight years and eight months, had been sent by her mother to a nearby shop to bring household items. According to the prosecution case, the accused, who had been keeping an eye on the child, lured her away and took her to his house.
He allegedly showed her obscene photographs on his mobile phone and sexually assaulted her. He subsequently gave her ₹10 for food.
The child resisted and indicated that she would tell her parents about what had happened. Fearing that his crime would be exposed, the accused allegedly picked up a chopper (koyta) and chased her.
The girl fell while attempting to escape. The accused then repeatedly attacked her with the chopper, striking her head, neck and face more than 15 times, resulting in her death.
*A Witness Was Also Attacked*
A 40-year-old passer-by reportedly witnessed the attack and attempted to intervene. The accused attacked him as well, with the weapon with an alleged intention to kill him.
*Swift Police Action and Investigation*
Dahanu Police Station registered Crime No. 189/2021 under Sections 376, 377, 302 and 307 of the Indian Penal Code, along with Sections 4, 6 and 12 of the Protection of Children from Sexual Offences (POCSO) Act, 2012.
The investigation was conducted by then Sub-Divisional Police Officer (SDPO), Boisar Division, Nityanand Jha, IPS.
The investigating team collected technical, scientific, medical and circumstantial evidence before filing the chargesheet against the accused.
24 Witnesses Examined During Trial
The prosecution examined 24 witnesses during the trial. Oral testimony, documentary evidence, scientific evidence and other circumstances were placed before the court.
The prosecution was represented by Special Public Prosecutor Adv. Rekha Hivrale.
WPSI Vidya Naresh Bore and PSI Sanjay Gavad also played important roles in the court proceedings, while investigation officer Nityanand Jha, IPS, led the investigation.
After examining the entire body of evidence and the arguments presented before it, Additional District and Sessions Judge Mrs. A. R. Rahane found the accused guilty and awarded the death penalty by hanging till death.
*First Such Death Sentence in Palghar’s Judicial History*
The verdict marks the first death sentence in the judicial history of Palghar district in a POCSO-related case involving the rape and brutal murder of a minor girl, making it a significant judgment in the district's legal history.
